Terms of Service

These Terms of Service govern your use of the BillFair platform, operated by Youtilities Pty Ltd (ABN 73 692 274 721) (“BillFair”, “we”, “us”). By using the platform you agree to these terms. If you do not agree, do not use the service.


1. Service description

BillFair is an independent electricity plan comparison service for Australian businesses. We allow you to upload an electricity bill or enter your usage details, compare market offers from multiple energy retailers, and initiate a retailer switch or plan change through the platform.

BillFair compares plans available in the national energy market. We do not compare all plans in every distribution zone, and results depend on the accuracy of the data you provide. We are not an energy retailer and do not supply electricity.

2. Eligibility

The BillFair service is available to Australian businesses. By using the platform you represent that you are authorised to act on behalf of the business whose electricity account you are managing. The service is not designed for residential electricity accounts; results may be inaccurate for residential usage profiles.

3. Free to compare — and optional paid services

Comparing electricity plans on BillFair is free for businesses. There is no subscription fee and no comparison fee. Where you choose to switch directly with a retailer on their own site, there is no switching fee either — you complete the switch with the retailer at no cost from us.

Some retailers can also be switched by BillFair on your behalf (a “managed switch”). This optional service carries a $49.99 inc GST fee. The fee is authorised as a hold on your card when you start, and is only captured if the retailer accepts the switch. If they do not, the hold is released and you pay nothing. See Section 4 for how BillFair is funded.

4. How BillFair is funded — referral fee and switch fee disclosure

BillFair may receive a referral fee from the energy retailer when a customer switches to that retailer using our platform. This fee is paid by the retailer, not by you, and is not added to your electricity costs.

For a managed switch, BillFair also charges you a $49.99 inc GST service fee as described in Section 3. This is a fee for performing the switch on your behalf — it is separate from, and additional to, any referral fee we may receive from the retailer, and it does not influence how plans are ranked or which plans are shown to you.

The receipt of referral fees does not influence plan rankings or comparison results. Plans are ranked by estimated annual cost based solely on your usage and published tariff rates. We do not receive higher fees for ranking particular retailers higher. Our comparison methodology is disclosed on the results page.

Where BillFair may receive a referral fee from a retailer, we will disclose this at the switch confirmation step with the notice: “BillFair may receive a fee from [Retailer] if you switch using our service — this does not affect your plan rate.”

5. Savings estimates — no warranty

All savings estimates displayed on the platform are indicative only. They are calculated by applying a retailer’s published tariff rates to your disclosed usage data and comparing the result against your current annualised spend. Actual savings depend on:

  • Changes in your usage patterns after switching.
  • Retailer rate adjustments after you switch.
  • Differences between your billing period and a calendar year annualisation.
  • Demand charges, controlled load tariffs, or solar feed-in components not captured in your uploaded bill.

BillFair makes no warranty, express or implied, that any estimated saving will be achieved. Estimated savings are labelled “estimated” throughout the platform.

6. Switching and plan changes

When you initiate a switch through BillFair, we contact the incoming retailer on your behalf by email. The retailer will then contact you directly to confirm and progress the transfer.

Full retailer switch: When you confirm a switch, BillFair will submit your transfer request to the new retailer within 1–2 business days. A confirmation email is sent to you immediately. To cancel before your switch is submitted, contact us at support@billfair.com.au as soon as possible.

Same-retailer plan change: No cooling-off period applies. The retailer will process your plan change at the start of your next billing cycle. No transfer of metering data occurs.

BillFair is not responsible for delays, failures, or errors in the retailer’s processing of your switch or plan change. If your switch is rejected by the retailer, we will notify you and assist you to resolve the issue.

7. AI bill processing

When you upload an electricity bill, the document is processed by Anthropic’s Claude AI for automated data extraction. The accuracy of comparison results depends on the accuracy of the data extracted from your bill. You are responsible for reviewing and correcting pre-filled fields before submitting a comparison. BillFair is not liable for errors in comparison results caused by inaccurate bill extraction.

8. Limitation of liability

To the maximum extent permitted by law, BillFair’s liability to you for any loss or damage arising from your use of the service is limited to the amount you have paid to BillFair in the 12 months preceding the claim. Where no fee has been paid, our liability is limited to $100 AUD.

BillFair is not liable for any indirect, consequential, special, or punitive loss or damage including loss of profits, loss of savings, or loss of data.

Nothing in these terms excludes or limits any right or guarantee under Australian Consumer Law that cannot be lawfully excluded.

9. Acceptable use

You must not use BillFair to:

  • Submit false or misleading information.
  • Initiate switches you do not have authority to action.
  • Attempt to access, reverse-engineer, or disrupt our platform or data.
  • Use the service for any unlawful purpose.

We reserve the right to suspend or terminate accounts that violate these terms.

10. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these terms.

11. Changes to these terms

We may update these Terms of Service from time to time. Material changes will be notified by email to registered users. Continued use of the platform after the effective date of updated terms constitutes acceptance of those terms.

12. Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute arising under these terms is subject to the exclusive jurisdiction of the courts of Victoria.
